Germany is sanctioned and must reimburse carriers

News of the 20/11/2020

Following the establishment of the LKW-Mau, the method of calculating the electronic toll was contested by two Polish carriers and the Court of Justice of the European Union ruled in their favor.

Since 2004, Germany has included the operating costs of the traffic police in the electronic toll payment, but a judgment published on October 28 by the European Court specifies that only costs related to operating costs should be taken into account.

This decision will therefore set a precedent and many appeals are expected for Berlin. Repayments are estimated at several hundred million euros if all the carriers concerned take legal action.
